Applying for Probate

It may be that you, as an executor, are happy you can administer the estate but would appreciate assistance in making the application for probate.  If so then, so long as you provide all the necessary financial information we will make the application and, on receipt of the grant of probate will hand it to you to complete the administration.

In this case we charge of fixed fee of £500 plus VAT.

Applying for Probate and administering the estate

It may be that you would prefer to hand the administration to us to deal on your behalf.  If so we will have an initial meeting to discuss the estate following which we will take steps to confirm the value of the estate, prepare the application for probate, deal with any Inheritance Tax and Capital Gains Tax considerations, collect in the assets of the estate, settle any liabilities and distribute the estate to the beneficiaries.

Our fees for the are calculated by the time spent on the matter and it I not possible to give an accurate indication of fees until details of the estate are available.  At the outset of an administration we suggest that our fee will be a % of the value of the estate (from 1-3%).  A more precise quotation can be given once we have sufficient detail

External fees

In addition to our fees may be some external fees.  The probate application fee is £273 plus £1.50 for each copy of the grant of probate.  To protect executors it is advisable to place Statutory Notices in the London Gazette and a local newspaper.  Other fees may also arise during the administration.

It is difficult to give an accurate time scale as some aspects of the administration are not under our control.  For example, when collecting detailed valuations of the estate we are dependent on replies from banks, building societies and other agencies.  Once the probate application is made the Probate Service take up to 17 weeks to issue the grant.  We endeavour to deal with each matter as expeditiously as we can.
